Introduction
Maria is an experienced intellectual property partner with significant experience in a wide range of IP issues, including protection of trade marks, copyright, and domain names, among others.
Maria Sun is based in Sydney and engages in intellectual property matters for a variety of local and international clients across several industries. Maria has significant experience in advising on complex trade mark and branding matters. Her practice is also focused on disputes involving copyright, domain names, passing off, misleading and deceptive conduct, and advising on food and beverage regulatory issues, copyright, marketing and advertising, and consumer protection.
Maria has acted for a number of clients by carrying out IP due diligence work and advising on IP issues associated with corporate and financing transactions. Maria advises on, and is regularly involved, in contract drafting and negotiation for clients across various industries.
- Sydney Opera House Trust | Ongoing | Advise the Trust on IP matters, including trade mark portfolio management, copyright, marketing and advertising, trade mark oppositions and IP enforcement litigation.
- Chocoladefabriken Lindt & Sprüngli AG | 2018-present | Manage Lindt’s Australian registered IP portfolio (trade marks and registered designs) Also advise Lindt on consumer law, Food Standards Code and advertising standards matters in relation to product labelling, packaging and promotional materials.
- LEGO Group | Ongoing | Advises LEGO on a broad range of intellectual property and marketing matters including protection of its copyright, designs and trade marks; contentious IP matters including copyright and trade mark infringement litigation, trade mark oppositions; consumer protection and passing off litigation matters; marketing and R&D agreements; marketing advice and conducting marketing reviews; and trade promotions advice.
- World Triathlon Corporation | Ongoing | Manage WTC’s trade marks (owner of some of the world’s most well-known performance sport brands including IRONMAN, Triathlon, Cape Epic and City to Surf) in Australia and New Zealand
- AbbVie Group | Ongoing | Manage its large portfolio of brands in Australia and New Zealand (including BOTOX, JUVEDERM, COOLSCULPTING and HUMIRA). Additionally we act for AbbVie on contentious IP matters including trade mark infringement litigation, domain name disputes, trade mark oppositions, consumer protection and passing off disputes, conducting freedom to use reviews and providing marketing advice.
- Condé Nast | Ongoing | Assist Conde Nast with all Australian intellectual property matters for this leading global publisher, Condé Nast, for over 3 decades, on instructions from Conde Nast's attorneys in New York. This includes managing the large portfolio of brands (including VOGUE, VOGUE LIVING, GQ, VANITY FAIR, ARCHITECTURAL DIGEST etc) and acting in various contentious matters Including trade mark opposition and IP litigation.
- Discovery Communications | Ongoing | Act for Discovery Communications for many years in seeking registrations for its valuable brands including Discovery Channel, Discovery Kids, Animal Planet, House Hunters, TLC and acting in relation to trade mark prosecution and oppositions, domain name and copyright disputes in Australia and New Zealand.
- Confidential Client | Advising on IP aspects of various acquisitions for this energy company and its subsidiaries including advising and negotiating complex IP agreements setting out the guardrails of the use of its IP and primary brand.
- Tourism Australia | Ongoing | Assist Tourism Australia on trade mark protection, including securing trade mark registrations in Australia and internationally. Also advise on marketing, domain name, website and associated legal issues.
