Introduction

Tomer advises clients on designing and administering employee benefit plans, including qualified retirement, nonqualified, group health and welfare plans, employment agreements, and executive benefits.

Tomer Vandsburger advises clients on matters involving ERISA, the Internal Revenue Code, the Health Insurance Portability and Accountability Act (HIPAA), COBRA, and the Affordable Care Act. He assists plan sponsors with plan drafting, compliance matters, and responses to the IRS and U.S. Department of Labor plan audits and assessments. Tomer also advises on employee benefit issues arising in M&A and other corporate transactions, including due diligence, negotiation of purchase agreements and disclosure schedules, and implementation of benefit transition plans.  

Tomer also advises healthcare providers, health technology clients, and provider networks, including both for-profit and nonprofit entities, on HIPAA compliance matters during the development and implementation of compliance programs. He also drafts HIPAA compliance policies and procedures, negotiates business associate agreements, reviews security breaches, analyzes breach notification options, and prepares responses to audits initiated by the U.S. Department of Health and Human Services and state attorneys general.  

Another focus of Tomer’s practice is multiemployer pension plan (MEPP) matters for clients with unionized employees. He advises on plan health and stability, strategies for addressing underfunding issues, and the withdrawal process. He is a contributing author on MEPP topics to Bloomberg Law's Benefits Guide: Basics, Defined Benefit Plans, Collectively Bargained Multiemployer Pension Plans: At-Risk Plans.  

Tomer maintains an active pro bono practice, including preparing U-Visa applications for survivors of domestic violence seeking lawful status. He also leads Ashurst Perkins Coie’s relationship with the Washington State Office of the Attorney General’s Office of Military & Veteran Legal Assistance (OMVLA), through which dozens of firm lawyers have provided pro bono consultations to veterans and active-duty service members. Under Tomer's guidance, Perkins Coie received the 2023 and 2024 Veterans Heroes Law Firm Award from then-Washington State Attorney General Bob Ferguson for its support of OMVLA. 

Tomer currently serves on the board of directors for Launch, a Seattle-based nonprofit providing affordable before- and after-school and summer programming to students in Title I schools in King County, Washington. 

Before becoming a lawyer, Tomer taught American history to middle and high school students in a Title I school in Brooklyn, New York.
