Introduction
Tim represents, counsels, and defends clients in state and federal consumer protection, privacy, and IP matters.
Tim Carter has litigated on behalf of major media, gaming, entertainment, technology, and consumer goods clients in state and federal courts across the country, including cases involving First Amendment and other free speech issues. He has successfully drafted and argued dispositive motions in state and federal court and has represented clients under investigation by the FTC and DOJ.
In his advertising practice, Tim represents clients before self-regulatory bodies such as the National Advertising Division, as well as in litigation involving the Lanham Act, California’s Consumer Legal Remedies Act, California’s Unfair Competition Law, and California’s False Advertising Law.
In the privacy space, Tim defends clients in class-action litigation arising under the Telephone Consumer Protection Act, the Federal Wiretap Act, the California Invasion of Privacy Act, the Florida Telephone Solicitation Act, Washington’s Commercial Electronic Mail Act, and a wide range of other state consumer protection and privacy statutes.
In his counseling practice, Tim advises clients on data privacy, consumer protection, and IP matters, including state and federal wiretapping laws, rights of privacy and publicity, misappropriation, trademark, copyright, claim substantiation, endorsements and testimonials, false advertising, and FTC rules and guidelines, including the Green Guides. He has particular experience advising clients on right of publicity and misappropriation issues in connection with AI and other emerging technologies.
Tim works closely with content creators across a wide range of media on production-related legal matters, including content review and clearance for films, television shows, and commercials. He also counsels advertisers, advertising agencies, and production companies on labor and union-related production issues under collective bargaining agreements, including the SAG-AFTRA Commercials Contract.
Tim maintains an active pro bono practice that includes First Amendment, Freedom of Information Act, and IP-related work for freelance journalists, news organizations, and nonprofit entities.
