Introduction
Roman is an experienced Intellectual Property and litigator, trusted adviser on strategic Intellectual Property matters and in major corporate transactions.
Roman Brtka heads the German Intellectual Property team and contentious and non-contentious Intellectual Property (IP) matters. He represents clients before national and European courts in IP, unfair competition law (e.g. misleading advertising and other unfair commercial practices) and commercial matters and advises on complex IP assignments, purchase and license agreements . Together with his team he manages clients' IP portfolios and supports clients with drafting and negotiating a wide range of IP-related agreements.
His practice also covers legal advice in relation to marketing initiatives, advertisement law, branding, sponsorship and labelling aspects.
Through his role as in-house counsel during a secondment at the legal department of AUDI AG in Ingolstadt, where he was focusing on non-technical IP and advertising law matters, he has the necessary understanding for the challenges of balancing legal risks and business needs.
His clients include leading companies from the automotive, telecommunications, media and sports industries. He has in-depth industry knowledge, particularly regarding EU market entries and marketing campaigns, including ESG, green advertising and labelling. In addition, Roman has extensive experience in automotive regulatory affairs (such as homologation, fuel consumption and emission labelling), enabling him to advise at the critical interface between product development, marketing and intellectual property.
Roman studied law at the University of Passau and King’s College London and holds an LL.M. Eur. from Ludwig Maximilian University of Munich. He was admitted to the German bar in 2010 and is a qualified Business Mediator (MuCDR).
He is the author of numerous publications on intellectual property law and a frequent speaker at national and international events. Roman is a member of the German Association for the Protection of Intellectual Property (GRUR), the Design Committee of the European Communities Trade Mark Association (ECTA), and the Institute for Copyright and Media Law Munich (IUM). As ECTA Design Task Manager for the EU Design Reform Process, he is responsible for reviewing and commenting on legislative proposals and amendments.
Before joining Ashurst Perkins Coie in 2024, Roman was a Partner at the international IP law firm Bird & Bird LLP in Munich.

- Italian premium automobile manufacturer | Lead partner | 2024 – ongoing | Legal advice (contentious and non- contentious) regarding advertising and marketing materials, with a focus on IP and consumer law related aspects (e.g. efficiency labelling of new passenger cars, misleading advertising, green claims, pricing etc.).
