Jane Carmody

Jane Carmody maintains a diverse legal practice focused on environmental compliance, sustainability, and project development. She understands the business needs of private and public entities operating under complex statutory and regulatory frameworks. 

Her environmental practice includes advising clients on regulatory compliance and permitting issues under state and federal environmental laws, including the federal and Washington Clean Water Act; the Clean Air Act; the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and Washington’s superfund law; the Model Toxics Control Act; the Atomic Energy Act and the Uranium Mill Tailings Radiation Control Act; Washington’s solid waste management laws; and the Resource Conservation and Recovery Act and Washington’s counterpart, the Hazardous Waste Management Act. 

Jane’s environmental practice centers on three areas: environmental compliance counseling and audits, obtaining and defending permits, and supporting due diligence for real estate transactions. She works closely with clients across industries to assess compliance with environmental permits and regulations and helps design and implement environmental management systems. Jane also obtains land, water, and air permits and defends permit appeals at the local, state, and federal levels. 

Jane maintains a growing sustainability and climate law practice. She counsels clients on internal and external environmental, social, and governance compliance and policies, and she works with clients to help design and implement effective programs. She has experience with Washington’s climate laws, including the Clean Fuels Program and the Climate Commitment Act, and advises businesses on carbon offset and insetting projects. 

Jane’s zoning and land use practice covers multijurisdictional project development, from site selection to construction and operation. She handles preacquisition diligence, zoning and entitlement strategies, and local, state, and federal permitting. Her work often includes advising on Washington’s State Environmental Policy Act, local zoning and land use ordinances, subdivision laws, and related local and state regulatory frameworks. 

Jane is well-versed in international environmental law, including developments at the International Seabed Authority and regulations governing deep sea mining. She also monitors developments related to the high seas and plastics. 

Jane maintains an active pro bono practice with the Transgender Law Center, responding to letters sent by transgender and gender-nonconforming people in prisons and jails requesting legal information and resources.
