Introduction
David guides businesses through complex digital transformations; delivering strategic technology and commercial transactions for financial institutions and FinTech's across the full financial services value chain.
David Futter supports some of the world's leading businesses deliver complex technology-related transactions so that they can transform and grow their business. He focuses on digital transformations, particularly within the field of Fintech, having led deals for many of the major participants across the financial services value chains – including banks, processors, card schemes, tech vendors and merchants/retailers.
David also advises regularly on a wide range of IT procurement, outsourcing and service contracts, data protection and privacy regulation, and intellectual property law.
David is ranked in Chambers UK and Legal 500 for both Technology and Fintech law, with distinctive recognition for advising on innovative digital technologies and for providing "exceptional advice and service". Business Today recognized David as their stand-out lawyer for IT and Outsourcing, who "is shaping the legal framework of the digital age". - British Business Bank & A Government body | Lead Partner | Delivering the procurement, including leading negotiations, for the design, delivery and outsourced operation of an end-to-end digital platform and services for the administration over £80 billion of business lending via the UK’s Government’s covid emergency loan schemes.
- A leading global investment bank | Lead Partner | Delivering a multi-vendor procurement program, negotiating numerous tech and data vendors concurrently, to design, build and system integrate the bank's UK Marcus savings platform’s technology stack from scratch.
- A major European bank | Lead Partner | Leading on its program of supplier negotiations for the development and launch a new SME lending business, including negotiation of all core technology and partnership with eBay for the white label provision of its invoice finance product to eBay merchants.
- An EU Member State's Ministry of Digital Affairs | Lead Partner | Advising on a strategic central framework for regulatory best practice and model SLAs in procuring cloud-based products (including SaaS) government services.
- A UK payments regulator | Lead Partner | Advising on its competitive technology procurement for the clearing and settlement layers of the UK Government’s next generation digital platform for all UK future retail and inter-banking payments.
- A global bank | Lead Partner | Designing and delivering its operational resilience strategy for consolidating and remediating its global technology vendor contracts for compliance with local regulated outsourcing and digital operational resilience requirements across 20+ jurisdictions, including renegotiating over 300 technology contracts to achieve regulatory compliance.
- A leading global technology company | Lead Partner | Advising on its successful bid to provide IT infrastructure and associated banking services (in partnership with a global bank) for the Post Office's mandated provision of Universal Credit on behalf of the UK's Department for Work and Pensions.
- Visa | Lead Partner | Advising on the procurement of a new digital payments platform and associated operational services from IBM UK, including leading negotiation of the agreement for its outsourced operation.
- A leading global investment bank | Partner | on the development and launch of a world’s first multi-asset class digital asset platform, GS DAP™ including leading on the negotiations for the procurement of key technology infrastructure for the development of the proprietary platform.
- A FTSE 100 company | Lead Partner | on the development, implementation and fully managed operation of digital consumer-facing alert platform. The transaction involved a complex multi-vendor system integration as part of establishing a new, FCA-regulated revenue line for the company in the UK.
