Introduction
Talia works with clients across a wide range of industries to resolve their employment issues through strategic advice, dispute resolution and workplace training.
Talia advises clients in relation to industrial relations strategy and planning, enterprise bargaining, pay compliance, restructuring and industrial disputes. She assists clients to manage employment issues including workplace investigations, performance management and termination of employment. She is regularly involved in the conduct of court and tribunal proceedings and has extensive experience dealing with external regulators, including the Fair Work Ombudsman.
- Various retail, hospitality and fast-food clients | Advising in relation to identified underpayments of salaried and hourly paid employees including advising on award and agreement interpretation issues, remediation processes and compliance going forwards. Advising in relation to engagement with employees, unions and the Fair Work Ombudsman and responding to requests for information from the Fair Work Ombudsman.
- Australian retailer | Advising and representing the client in Federal Court proceedings commenced by the Fair Work Ombudsman. Advising and representing the client in class action proceedings in the Federal Court commenced on behalf of employees in relation to identified underpayments. Advising and representing the client in proceedings in the Federal Circuit and Family Court of Australia and appeals in the Federal Court concerning alleged breaches of an enterprise agreement.
- Australian retailer | Advising in relation to enterprise bargaining strategy and planning, bargaining-related disputes and enterprise agreement approval processes, including contested approval applications in the Fair Work Commission and an application for judicial review of an agreement approval decision in the Federal Court. Advising in relation to protected industrial action.
- Australian retailer | Advising in relation to industrial relations strategy and planning, transfer of business issues, award/agreement interpretation issues and employment/industrial disputes.
- Qantas Airways Limited | Advising in relation to enterprise bargaining on various agreements, including BOOT compliance reviews and assisting with agreement approval processes.
- Australian Hospitality Group | Advising in relation to industrial relations strategy and planning, transfer of business issues, award/agreement interpretation issues and employment/industrial disputes. Acting in the contested approval of the Group's enterprise agreement.
- Australian University | Advising in relation to ongoing pay remediation programs, including engagement with the Fair Work Ombudsman under the terms of an Enforceable Undertaking. Advising in relation to individual employee claims. Advising in relation to a review of long service leave obligations.
- Qantas Airways Limited | Advising in relation to employee misconduct investigations. Representing Qantas in court and commission proceedings. Developing and conducting workplace training for HR and Line Managers in relation to workplace investigations, employee management and compliance with industrial instruments.
- Qantas Airways Limited | Acting for Qantas Airways Limited in long-running discrimination proceedings commenced by a former employee involving proceedings in the Federal Court and an application for special leave to appeal to the High Court of Australia.
- OK Group | Advising on the establishment of OK Group's Australian business, including employment contracts and employee policies.
