Introduction

With two decades of experience, Melanie advises digital health startups on commercialization and governance for scalable virtual care, and employers on health and welfare benefits.

Drawing on her background as digital health general counsel, Melanie Curtice helps digital health companies with practical, outcomes-focused legal and strategic support. This includes regulatory strategy and compliance to reduce risk in product development and market entry; commercial contracting and go-to-market counsel; and support during M&A, financings, and strategic partner engagements.

Melanie also helps large public and private employer clients comply with ERISA, HIPAA, the Internal Revenue Code, the Affordable Care Act, and other federal and state requirements to reduce the risk of agency penalties and participant benefit claims. She counsels employers on self-funded health benefits, high-deductible health plans and health savings accounts, health reimbursement arrangements, cafeteria plans, and voluntary benefits. She assists with planning related to self-funded welfare plans using Internal Revenue Code Section 501(c)(9) voluntary employees’ beneficiary association trust arrangements, health reimbursement arrangements, and health savings accounts. In addition, her practice includes advising on ERISA fiduciary matters associated with health and welfare and retirement plans.

In her support of clients during M&As, Melanie advises on benefit plan issues that arise in connection with due diligence and closed transactions, including post-transaction issues associated with acquired entities.
