Mark Disney is highly regarded for his work in the negotiation and documentation of deals in the infrastructure, mining and defense sectors. He often assists clients managing the delivery of these projects and navigating execution of projects. He acts on transactions throughout Australia, New Zealand and PNG.
- Eva Copper Mine | Lead partner | 2023- ongoing | Advising Harmony Gold and Eva Copper Mine Pty Ltd on the arrangements to procure development of the Eva Copper Mine, including negotiating and documenting the mine development and mine operation contract, negotiating and documenting the EPC for the process plant (together with associated performance guarantees), negotiating and documenting the hybrid power supply arrangements and negotiating and documenting a large number of major supply contracts in connection with the project.
- Northern Beaches Hospital PPP | 2025- ongoing | Advising the receivers to the Healthscope Group on the negotiation of arrangements between the State of NSW and Healthscope in connection with the termination and transition of the Northern Beaches Hospital PPP from Healthscope to the State, including advice on the State's ability to terminate the Project Agreement under legislation.
- DTRS Project | Lead partner | 2021 - ongoing | Advising a state government agency on the arrangements to extend the current Digital Train Radio System project with Nokia-Siemens, including amendments to the current contract and the interaction between the Project and the rail franchisee.
- Melbourne Metro Tunnel Operations | Lead Partner | 2022 - ongoing | Advising a state government agency on the arrangements to bring the Melbourne Metro Tunnel into operations, including the negotiations of necessary amendments to the MR4 Rail Franchise Agreement with MTM along with extensive advice on implications of bringing the tunnel into the franchise.
- ANI – Submarine Construction Yard: | Lead Partner | 2026 – ongoing | Advising the WeBuild / Hyundai / Downer JV on its bid for the nuclear and non nuclear components on this project to construction a naval construction yard in Osbourne South Australia in connection with the AUKUS Program.
- Inland Rail Project | Lead partner | 2016 - ongoing | Advising the Queensland Department of Transport and Main Roads on all aspects of the State of Queensland's involvement in the $12 billion Inland Rail Project, including advising on the project arrangements between the State and Commonwealth, the arrangements between the State and ARTC, the State and IRPL and the arrangements between the State and Queensland Rail. Mark also advised on constitutional arrangements in connection with the project.
- Queensland Department of Transport and Main Roads | Lead partner | 2022 | Advising the on a number of extensions to the Passenger Rail Transport Services Contract and being part of the Ashurst team on the 2021-2022 rewrite of the Passenger Rail TSC and in the negotiations with Queensland Rail.
- Downer/Spotless | Lead partner | 2017 - ongoing | Advising in relation to their successful bid for the NZ Central Rail Link on package 3, 5 and 7 in Auckland. This includes advising on the Project Alliance Agreement for delivery of the infrastructure and the maintenance contract for post construction services as well as all joint venture and interface arrangements.
- Nexus Consortium | | 2017– 2022 | Acting for the successful bidder, Nexus Consortium (comprised of Plenary / Acciona / Ferrovial) on this project and subsequent negotiations.
- Australian Unity Healthcare Property Trust | Lead partner | 2017 - 2021 | Advising the Heath Property Trust / Australian Unity Limited as Project Co on its involvement in SRACC Hospital PPP which was part of Stage 3 of the Herston Quarter development. Mark negotiated a rebalancing of the project to mitigate project delays and also the arrangements between the Health Authority, the D&C Contractor, the O&M Contractor, the Master Developer, the Funders and Project Co to secure commercial acceptance.
