Introduction
Lorraine is known for her in-depth knowledge and experience in handling clients' complex commercial and regulatory disputes.
Lorraine advises on complex commercial litigation and arbitration, as well as regulatory investigations and commissions of inquiry.
She regularly represents global financial institutions, mining companies, major accounting and consulting firms, and technology companies. Her regulatory investigations work includes advising clients on a range of corporate, banking, securities and tax matters, and representing clients in follow-on enforcement litigation. Lorraine has acted on some of the largest class actions in Australia, including representing Lehman Brothers and Royal Bank of Scotland in relation to securities claims by investors.
Lorraine is entrusted by companies to navigate significant issues and manage litigation effectively with a commercial focus and using alternative dispute resolution processes to bring disputes to an early end where possible.
- Ride-sharing company | Representing the company in proceedings against NSW Chief Commissioner of State Revenue relating to the application of payroll tax, including in the appeal before the High Court of Australia.
- Mining company | Representing the mining company as claimant in a confidential arbitration against a State entity for breach of AUD 500 million contract.
- Major Australian bank | Advising the securities business in relation to ASIC investigations for breach of securities market regulation.
- GPT | Representing GPT in proceedings against NSW Chief Commissioner of State Revenue relating to stamp duty.
- Department of Health | Representing the Department in bringing proceedings for civil penalties for breach of advertising prohibitions in the Therapeutic Goods Act.
- ASX listed company | Acting for a mining company in an ASIC investigation for breach of continuous disclosure obligations and misleading conduct relating to environmental impact of its operations, resulting in no further regulatory action.
- Bank directors | Representing executive and non-executive directors of an authorized deposit-taking institution in an APRA investigation relating to breach of Financial Accountability Regime obligations and follow-on appeals in the Administrative Review Tribunal.
- Big 4 accounting firm | Acting for the firm in several proceedings defending against professional negligence claims in relation to audit, consulting and tax businesses, and responding to regulatory inquiries by ASIC and ATO.
- Australian Taxation Office (ATO) | Advised the ATO in relation to the Royal Commission into the Robodebt Scheme.
- Leading US investment bank | Advising in several ASIC investigations and acting for individuals in ASIC examinations relating to investment banking and equity mandates, resulting in no further regulatory action.
