Introduction
Julie represents internet, technology, and social media companies in privacy litigation and third-party legal process compliance.
Julie E. Schwartz litigates disputes arising under the Stored Communications Act, the Communications Decency Act, the First Amendment, California's Yelp Law, and other federal and state privacy laws. She also handles class-action litigation involving alleged privacy violations and other related claims.
Julie helps manage Ashurst Perkins Coie's Electronic Communications Privacy Act compliance group, where she leads teams that counsel service providers on data security issues and third-party requests for information. These requests involve demands for user data and corporate records in civil and criminal cases, Section 1782 proceedings, and Digital Millennium Copyright Act actions. She frequently appears in state and federal courts in California and across the country to argue issues arising from these requests on behalf of service providers. She is knowledgeable of California and federal law as it applies to nonparty discovery.

Represent Google in ongoing litigation regarding whether a search warrant issued pursuant to the Stored Communications Act, 18 U.S.C. §§ 2701-2710, can be used to compel a communications service provider to seize customer communications stored outside the United States and disclose them to the government.

Successfully defended motion to compel production of the identity of an anonymous speaker pursuant to domesticated subpoena in connection with out-of-state litigation.
Opperman v. Path, Inc. et al.
U.S. District Court for the Northern District of California
Currently defending Twitter Inc. against putative class action asserting invasion of privacy and related claims against Apple and iOS application developers that allegedly copied iPhone users’ mobile address books without consent. Motion to dismiss granted on virtually all claims.
Jancik v. Redbox Automated Retail, LLC
U.S. District Court for the Central District of California
Defended Redbox against disability discrimination and false representation claims relating to captions for the hearing impaired on movie DVDs distributed at retail store kiosks. Motion to dismiss granted on all claims asserting that Redbox may include in its rental inventory only closed-captioned films.
Dobson v. Sprint Nextel Corporation
U.S. District Court for the District of Nevada
Motion to dismiss all claims granted in invasion of privacy lawsuit alleging that Sprint’s location services misdirected law enforcement and individuals attempting to locate their cell phones to the plaintiff’s home. Case subsequently dismissed by the plaintiff with prejudice.
Contract Dispute Litigation*
Achieved summary judgment with successful arguments based on the interpretation of a fee agreement in a contract dispute on behalf of a leading venture debt firm.
Product Liability Cases for Pharmaceutical Companies*
Managed and prepared pleadings, motions and other briefings for hundreds of oral contraceptive product liability cases pending in state court, federal court, the Judicial Council Coordinated Proceeding and the multidistrict litigation proceeding on behalf of Fortune 500 pharmaceutical companies.
