Introduction
Javier is a seasoned multijurisdictional litigator with a focus on employment and business disputes.
Javier F. Garcia represents clients in a wide range of litigation matters, including cases involving race, age, disability, and gender discrimination; harassment and retaliation; wage-and-hour class actions; noncompete agreements; Sarbanes-Oxley whistleblower claims; and collective bargaining agreement disputes. He also represents companies in complex contractual disputes, as well as business torts, trade secrets, and unfair competition claims. He is licensed in Washington, California, and Hawaii, and routinely litigates in courts nationwide.
Outside his litigation practice, Javier counsels California, Washington, and Hawaii clients on employment issues involving employment policies and handbooks, employment contracts, and severance agreements. He helps California clients comply with the state’s highly regulated employment environment. Javier also advises clients on labor matters subject to collective bargaining agreements, including labor arbitrations, unfair labor practices, strikes, and National Labor Relations Board administrative hearings and appeals.

Plaintiff, a former executive, asserted a seven figure damage claim for fraud, negligent misrepresentation and breach of contract against the client. Successfully obtained summary judgment ruling in favor of client, thereby dismissing the case, in its entirety, prior to trial.
