August Tip of the Month: EEOC Proposes to Rescind EEO-1 Reporting
On July 21, 2026, the EEOC issued a Notice of Proposed Rulemaking (“Notice”) to rescind the requirement that employers file certain annual reports, most notably the EEO-1 report required of private employers with 100 or more employees and certain federal contractors with 50 or more employees. The Notice is not yet law; the current requirements for EEO-1 reporting remain in effect unless and until the Notice is finalized. Further, even if the Notice goes into effect, covered employers may be required to provide the information contained in an EEO-1 report to the EEOC during an EEOC investigation, or to a local/state agency which independently imposes reporting requirements. Employers should not yet modify their reporting practices, but should monitor developments related to the Notice in order to assess their regulatory compliance obligations.
