Introduction
Joseph is a construction and energy authority advising on complex disputes and major infrastructure projects across multiple sectors, jurisdictions, and contract forms.
Joseph Harrington has experience of a wide range of contentious, strategic advisory and non-contentious matters across construction, utilities, oil and gas, energy transition (renewables, hydrogen, carbon capture, battery energy storage system/BESS, district heading), transport (road and rail), manufacturing (road and rail vehicle components, chemicals, metals, sustainable aviation fuel), PFI (health, education, housing) real estate development and infrastructure projects.
He has acted for large infrastructure funds, banks, employers, manufacturers, rolling-stock owners, commercial and industrial landowners, major energy companies (State-owned and private), central government departments and local authorities, major multinational contractors, specialist subcontractors, joint venture consortium members, luxury hotel owners and fuel and equipment suppliers.
He focuses on construction and energy litigation, arbitration, adjudication, and alternative dispute resolution processes (including expert determination and mediation). He has particular experience of matters involving delay, disruption, termination, and suspension claims on projects involving biomass, energy-from-waste, solar, wind, and gas power plants, as well as claims against bonds, novation, assignment, claims arising from coronavirus, war, force majeure and changes in law and claims involving regulatory and criminal liability. He has advised on LCIA, ICC, UNCITRAL, ICE and ICCR arbitrations, with seats including London, Hong Kong, and Dublin in energy, construction, and intellectual property disputes.
He has experience of design & build, EPC, DFBO, O&M, and FM contracts, direct agreements, collateral warranties, performance bonds, funding agreements, asset protection agreements, and power purchase agreements, and of standard form (JCT, NEC3, NEC4, IChemE and FIDIC) and bespoke construction contracts, as well as PFI contracts involving the construction or operation of healthcare facilities, schools, power generation, waste disposal, office maintenance, and the design, construction, and operation of road assets. He has experience of disputes involving parties in England and Wales, Scotland, Ireland, Northern Ireland, Australia, the United States, the Middle East, Europe, Latin America, and Africa.
