McKenzie Electric Cooperative, Inc. v. Basin Electric Power Cooperative

On June 22, 2026, McKenzie Electric Cooperative, Inc. (McKenzie) filed a request for rehearing of FERC's May 2026 order denying McKenzie's complaint. The underlying complaint alleged that Basin Electric Power Cooperative (Basin) pursued a nominal Rural Utilities Service (RUS) loan to avoid FERC jurisdiction. McKenzie argues that rehearing is warranted because FERC failed to provide "any reasoned analysis" of whether Basin's purposeful evasion of federal jurisdiction was compatible with the public interest, as required by FPA section 204.

Two intervenors—Sierra Club and Tri-State Generation and Transmission Association, Inc. —also filed requests for rehearing. They make similar claims about the May 2026 order.

Agenda item E-1 may be an order on the rehearing requests.

    North American Electric Reliability Corporation

On August 24, 2026, the North American Electric Reliability Corporation (NERC) filed a request with FERC for acceptance and approval of (1) its 2027 proposed business plan and budget; (2) the proposed business plans and budgets for the regional entities for 2027; and (3) the proposed assessments to fund the budgets.

The waiver that IGS CTS requests would allow its solar photovoltaic generating facility (the Facility) to be deemed a qualifying facility, eligible for the regulatory exemptions in 18 C.F.R. §§ 292.601 and 292.602, for the period from December 3, 2025, through June 17, 2026. IGS CTS seeks the waiver because it inadvertently failed to timely file a required self-certification form (Form 556) for the Facility.

Agenda item E-3 may be an order on IGS CTS's petition.

    Lost Island Wind Energy, LLC

Lost Island Wind Energy, LLC (Lost Island) is developing the Lost Island Wind Project, a utility-scale wind generation facility located in Palo Alto County in northwestern Iowa. On July 31, 2026, Lost Island submitted a petition requesting a prospective, limited waiver of Article 2.3.1 of the Generator Interconnection Agreement (the GIA), and Section 4.4.4 of Attachment X to the Midcontinent Independent System Operator, Inc. (MISO) Open Access Transmission Tariff (the Tariff). In its petition, Lost Island seeks to extend the Project’s COD from December 14, 2028, to December 14, 2030, because litigation over the Project’s site permit, pending before the Iowa Supreme Court, has created uncertainty that has significantly disrupted the Project’s development, making compliance with the current COD as set forth in the GIA impossible to achieve.

Agenda item E-8 may be an order regarding Long Island’s petition for a requested waiver and COD extension.

Revisions to Oil Pipeline Regulations Pursuant to the Energy Policy Act of 1992

On December 22, 2025, Kinder Morgan, Inc. (KMI) requested limited clarification or, in the alternative, rehearing of the Commission’s November 20, 2025, order (the Remedies Order) granting remedial relief to certain liquids pipelines for a period ranging from March 2022 into September 2024 (the Locked-In Period) in order to place those pipelines in the position they would have been in absence of the issuance of a now-vacated earlier order. KMI’s filing noted that KMI fully supports the remedial relief granted in the Remedies Order, but it sought clarification that the Commission did not intend to limit the circumstances under which remedial relief is available to pipelines to just those instances where pipelines were charging the maximum rates permitted under the now-vacated earlier order. In the alternative, KMI sought rehearing of the Remedies Order to the extent it prohibits pipelines that charged rates below certain Maximum Rehearing Index Rates but that were still impacted by the now-vacated earlier order from obtaining the same remedial relief as that afforded to pipelines that charged the Maximum Rehearing Index Rates during the Locked-In Period.

On the same day, Energy Transfer LP (Energy Transfer) requested clarification of the Remedies Order that the recouped assessments for “amounts that would have been chargeable” during the Locked-In Period include interest on the calculated amounts.

Agenda Item E-11 may be a further order on RMI’s and Energy Transfer’s requests for rehearing and clarification.

Five-Year Review of the Oil Pipeline Index

The requests for clarification or rehearing, filed in Docket No. RM93-11-004 were also filed in Docket No. RM20-14-005.

Agenda item G-2 may be an order on these requests.

Authorizations for Certain Activities at Liquefied Natural Gas Plants

On November 20, 2025, the Commission issued a notice of inquiry seeking information and stakeholder perspectives to help the Commission explore whether, and if so how, to establish procedures for authorizing activities at liquefied natural gas (LNG) plants without the need for case-specific authorization applications and orders under Sections 3 or 7 of the Natural Gas Act (NGA). Between January 16, 2026, and January 27, 2026, several entities submitted comments for the Commission’s consideration.

Agenda item C-1 may be a further issuance relating to the Commission’s notice of inquiry.

On October 15, 2025, Columbia Gulf Transmission, LLC submitted an Abbreviated Application for Certificate of Public Convenience and Necessity pursuant to Section 7(c) of the Natural Gas Act to construct and operate certain natural gas pipeline facilities through its Pulaski Project, which would service new and existing generation resources at the John S. Cooper Power Station and supply 253 million standard cubic feet per day of natural gas transportation. On January 7, 2026, the Commission issued Notice Of Schedule for the preparation of an Environmental Assessment for the project.

    Louisiana LNG Infrastructure LLC

    Driftwood Pipeline LLC

On June 1, 2026, Louisiana LNG Infrastructure LLC (Louisiana LNG) submitted an application for limited amendment to authorization granted under Section 3 of the Natural Gas Act and request for expedited action. The authorization was granted in 2019 to Louisiana LNG’s predecessor, Driftwood LNG LLC (Driftwood), in Docket No. CP17-117-000. The requested amendment would incorporate an interconnect and receipt meter station (the KMLP Interconnect) that would interconnect the Louisiana LNG facility with the Kinder Morgan Louisiana Pipeline LLC (KMLP) interstate natural gas pipeline system, allowing Louisiana LNG to serve as a significant source of natural gas supply for the Project quicker than is available from other supply sources. Simultaneously, Driftwood Pipeline LLC requested to vacate this same facility from its facilities authorized under Section 7(c) of the Natural Gas Act (Docket No. CP17-118-000). On June 30, 2026, the Commission issued an Environmental Assessment Report for Louisiana LNG and Driftwood’s application.

Agenda item C-4 may be an order on this application.
