This Recruitment Privacy Notice (“Recruitment Notice”) describes how the Ashurst Perkins Coie Group (“Ashurst Perkins Coie,” the “Firm,” “we,” or “us”) collects, uses, discloses, or transfers Personal Data ("Process") about you when you interact with us as set out in the Scope section. “Personal Data" under this Recruitment Notice means any information which relates to an identified or identifiable individual. The "Ashurst Perkins Coie Group" includes Ashurst Perkins Coie UK LLP, Ashurst Perkins Coie US LLP, Ashurst Perkins Coie Australia, and any entity that is affiliated with, controlled by, or under common control with any of them, and any entity that is authorized to use any of the names "Ashurst Perkins Coie," "Ashurst," or "Perkins Coie."
This Recruitment Notice explains how we Process Personal Data when you apply for a any employment role at Ashurst Perkins Coie including business professional roles, lawyer positions, partner candidates, internships, graduate roles, and vacation scheme positions (“Job Applicants”). This Recruitment Notice also provides information about Job Applicants’ rights in relation to the use of their Personal Data.

Scope
This Recruitment Notice describes our practices in connection with Personal Data we collect online and offline about Job Applicants. It applies to Personal Data provided directly by Job Applicants, submitted through our recruitment portals, shared through recruitment agencies, or otherwise received from third parties, including referees, in connection with an application for employment.
If we hire you, information we collect in connection with your application will become part of your employment records and be used during the onboarding process and for other employment-related purposes in accordance with our internal Personnel Privacy Notice
The Firm and Our Role
Ashurst Perkins Coie operates globally through entities in the US, UK, Australia, the European Union (EU), European Economic Area (EEA), Asia, and the Middle East.
The relevant Ashurst Perkins Coie entity you deal with typically acts as a "Controller" ‘or “Business” for your Personal Data under applicable data protection laws. This means that the Ashurst Perkins Coie entity determines the purposes for which, and the means by which, Personal Data is Processed.
Collection of Personal Data

Tax-related information, compensation structure, and compensation history, when legally permitted to be disclosed;

Profile data: such as information provided by you when you apply for a position using our electronic portals and platforms, including passwords, security questions and answers, profile settings, date of registration, and current state of registration;

Government-issued identification numbers and financial information, such as social security number, driver’s license number, alien number, or state-issued identification number; bank account details, tax and social security number, national or other identity numbers.

Information for compliance and risk analysis, such as Job Applicants’ prior client engagements, their immediate family members employed in judicial or legal fields, and their involvement in claims, litigation, or regulatory inquiries; client-related investments or ownership; and information regarding clients with prominent public functions, including their family members and close associates;

Reference information, such as information you provide relating to references.

Work authorization and immigration information, such as your work authorization status and relevant visa or immigration information.

Attendance, visitor, and event information, such as details of your attendance at our offices or events, visitor and attendance logs, government-issued identification to access one of our physical premises, information on identification passes issued for access to our premises, offices visited, entry and exit times, travel and accommodation details, dietary restrictions, and other event-specific information you share with us.

Health-related information, such as accessibility requirements and, where necessary and appropriate to protect the health and safety of our personnel and others, information relating to symptoms of, or risk of exposure to, certain illnesses.

Online account information, such as username and password to access career portals, application identifiers, and IP address and device identifiers that may be automatically collected;

Other information you choose to provide, such as employment preferences, willingness to relocate, and desired salary.
Sensitive Personal Information: Sensitive Personal Information includes information about an individual's racial or ethnic origin, gender, nationality, religion or similar beliefs, political opinions, veteran status, and information relating to their health, sexual life, or orientation. To the extent permitted by law, we may request that Job Applicants provide certain categories of Sensitive Personal Information for equal opportunity monitoring. However, if you decide not to provide this information, your application will not be prejudiced, and no adverse inference will be drawn. Job Applicants may also voluntarily provide Sensitive Personal Information as part of their application, or other data from which this may be inferred, in which case we will Process any such information in accordance with applicable laws. We may also Process health-related information to make appropriate arrangements for you to attend our offices and/or participate in an interview.
Information We Collect Automatically
We automatically collect information about Job Applicants such as when monitoring the use of the Firm’s premises, equipment, devices, computers, network, applications, software, or similar assets and resources. Such information includes:

Geolocation information, such as when you use your badge to enter the Firm’s offices;

Usage data, such as browser type, ISP domain names, referral website, pages visited, actions taken, content-view details, page-visit patterns, visit duration, number of visits, navigation path, interactions, functionalities or modules used, and chat messages.

Audio or visual information, such as information from cameras and closed-circuit television (CCTV) installed on-premises; and
-
CCTV and site security information, such as images or video footage captured or recorded by CCTV and other security measures on our premises.
Personal Data We Collect from Other Sources
We may also collect Personal Data about you from other sources, including publicly available databases, and combine that with information we collect from Job Applicants. The types of Personal Data we collect from other sources include:

Social media information, such as profile pictures, social media account ID, and other public social media profile information;

Results of adverse media searches, where permitted by applicable law and where necessary for the specific role applied for, as part of our pre-employment screen and verification checks;

Event photographs and videos, such as photos and videos taken at one of our events/conferences;

Recruitment-related feedback, such as notes of conversations with Job Applicants, feedback from references, prior employers, recruiters and recruitment agencies, and others involved in the recruitment process; and

Background screening and verification information, if you are successful in your application, and if permitted by applicable law, including criminal records checks, verification of qualifications and employment history, financial checks, and, for U.S. candidates, credit checks.

Data protection laws require that we only Process Personal Data where we have a lawful basis (i.e., a legal justification) to do so. You are under no statutory or contractual obligation to provide data to us during the recruitment process. However, if you do not provide certain information, we may not be able to process your application. If your application is successful, it will be a condition of any offer of employment that you provide satisfactory references and evidence of your right to work.
Disclosures of Personal Data
We may disclose your Personal Data to persons, groups, or entities as follows:

Related entities, including our affiliates, subsidiaries, and other companies under common control and ownership as well as individuals involved in the recruitment process, including hiring managers;

Service providers and contractors, that provide services on our behalf including recruitment agencies we engage to assist with our recruitment; background check and due diligence providers, providers of IT systems, and our recruitment platform operators.

Business transferees, such as in connection with, or during negotiations of, any merger, combination, financing, divestiture, restructuring, reorganization, dissolution, or other sale of Ashurst Perkins Coie’s assets or acquisition of all or a portion of our business to another company. In the event of such a change to our business, the new owners or combined organization may use your Personal Data in accordance with this Recruitment Notice;

Law enforcement, public, regulatory and government authorities, courts, or tribunals, when we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;

To enforce agreements or policies, if we believe your actions are inconsistent with our agreements or policies, or to protect our rights, property, and safety or the safety of any third party; and

With your consent or at your direction, including if we notify you that your Personal Data will be disclosed in a particular manner and you provide such Personal Data.
We may also produce, store, and share aggregated or de-identified information, which cannot reasonably be used to identify you for our own internal purposes, or to share with carefully selected third parties. Aggregated information may be derived from Personal Data but is no longer considered Personal Data under data protection law once individual identifiers have been removed. Ashurst Perkins Coie processes, maintains, and uses this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.
Data Retention
To determine the length of time the Firm retains Personal Data, the Firm considers numerous factors, including: (i) the duration of the application process; (ii) the period of time that we have an ongoing relationship with you; (iii) legal obligations to which we are subject; and (iv) as advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).
Automated Decision-Making
Automated decision-making or "ADM" is the process of making objective decisions by automated means, based on pre-defined criteria, without any human intervention. We will only use automated decision-making where permitted by law. ADM is not used for any recruitment activities in the United States.
Ashurst Perkins Coie typically receives a significant volume of applicants for certain positions we regularly recruit for. If you apply for a training contract, vacation placement, clerkship, or solicitor apprenticeship in the UK, Australia, or Hong Kong, we may use third party online assessment tools as part of the application process. These assessments are designed to tell us whether you are likely to enjoy working with us, and whether you have the overall skills to be successful at Ashurst Perkins Coie. For certain roles, if you do not meet or exceed the required assessment score you will be unable to progress any further in the process. Express consent to the use of automated decision-making based on the assessment scores will be requested before you start the assessment.
Aside from applications for these roles in these jurisdictions, no profiling or automated decision making will take place to determine suitability or eligibility for employment or engagement as a contractor.
If you choose not to provide consent or subsequently withdraw your consent, we will not Process (or will stop Processing) your Personal Data using those techniques. If you ask us for a human review of an automated decision by contacting data.protection@ashurstperkins.com, we will manually review the automated decision and confirm whether or not it was correct.
Please note that Ashurst Perkins Coie is an inclusive employer. We have taken positive action to ensure that the recruitment decisions we make are objective, free from bias, and based upon individual skills and potential. For example, our automated decisions never use sensitive (or ‘special categories' of) Personal Data that could be used to discriminate on the basis of gender, ethnicity, race, and religion.
Security
We maintain appropriate technical, organizational, and physical safeguards to protect your Personal Data, considering the nature of the Processing and the risks to individuals. We limit Personal Data access to those who need it for the purposes described in this Recruitment Notice. Our security program, which is supported by our ISO 27001 certification and other security standards, processes, and procedures, includes access controls, password protection, encryption at rest and in transit, multifactor authentication, vulnerability management, logging, monitoring, alerting, and personnel training. We also require individuals with regular access to Personal Data to protect its confidentiality
However, no information system is completely secure, and we cannot guarantee the protection of any Personal Data you choose to transmit to our Websites.
California Residents
The California Consumer Privacy Act (“CCPA”) requires the Firm to disclose certain information to California residents regarding the collection and use of personal information.

Other Details About Our Information Practices

We do not “sell” or “share” and have not “sold” or “shared” Personal Data in the preceding 12 months under the laws applicable to you.

The Firm does not knowingly sell or share Personal Data about individuals under the age of 16.

We collect information that is considered “sensitive” under the CCPA in connection with Job Applicants but do not use or disclose sensitive Personal Data for the purpose of inferring characteristics about you.

Your Rights Under the CCPA
Access, Correction, and Deletion
You have the right to: (1) request to know more about and access your Personal Data, including in a portable format; (2) request deletion of your Personal Data: and (3) request correction of inaccurate Personal Data.

You have the right not to be discriminated against for exercising any of your privacy rights.
Authorized Agents
If you reside in California, you may also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as valid power of attorney or proof that they have signed permission from the individual who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify such individual’s own identity or confirm the authorized agent has permission to submit the request. International Transfers
Ashurst Perkins Coie has operations and vendors in the United States, UK, EU, Australia, and other countries. Therefore, Processing your application may involve sending Personal Data outside the jurisdiction where it was collected, including to jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction. While in another jurisdiction for Processing, the courts, law enforcement, and national security authorities of that jurisdiction may access your Personal Data. In such cases, we put in place appropriate measures designed to ensure that such Personal Data is given adequate protection at its destination, in compliance with applicable laws.
As described below, if you are in the EEA, Switzerland, or the UK, we provide adequate protection for the transfer of Personal Data to certain Ashurst Perkins Coie U.S.-based entities by adhering to the EU-U.S. Data Privacy Framework, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework as set forth by the U.S. Department of Commerce. Cross-border transfers may also be governed by the European Commission's Standard Contractual Clauses ("SCCs"), which can be found here and the UK Addendum to the EU SCCs, which can be found here.

Data Subject Requests
Subject to certain limitations, you have the following privacy rights:

The Data Protection Framework
Ashurst Perkins Coie US LLP (formerly Perkins Coie LLP) entities based in the U.S., Ashurst Perkins Coie US LLP and Ashurst Perkins Coie Trust Company LLC (“Ashurst Perkins Coie DPF Entities”), comply with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) (together, the “DPF”) as set forth by the U.S. Department of Commerce.
Ashurst Perkins Coie DPF Entities have certified to the U.S. Department of Commerce that the entities adhere to the EU-U.S. DPF Principles with regard to the Processing of Personal Data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Ashurst Perkins Coie DPF Entities have certified to the U.S. Department of Commerce that they adhere to the Swiss-U.S. DPF Principles with regard to the Processing of Personal Data received from Switzerland in reliance on the Swiss-U.S. DPF. Each of these principles are collectively referred to as the “DPF Principles.”
If there is any conflict between the terms in this Recruitment Notice and the DPF Principles, the DPF Principles shall govern.

Consent
Most Personal Data disclosures we make are to service providers, contractors, and professional advisors performing work on our behalf under contracts.
To the extent Personal Data is used or disclosed for a purpose materially different from the original collection purpose, we will notify you regarding how to opt out. With respect to sensitive Personal Data disclosed to a third party or used for a new purpose that is different from that for which the sensitive Personal Data was originally collected or subsequently authorized, we will obtain your opt in consent before such use or disclosure.
Ashurst Perkins Coie DPF Entities’ Internal Complaint Mechanism
In compliance with the DPF, Ashurst Perkins Coie DPF Entities commit to resolve DPF Principles-related complaints about our collection and use of your Personal Data. EU, UK, and Swiss individuals with inquiries or complaints regarding our handling of Personal Data received in reliance on the DPF should first contact us at data.protection@ashurstperkins.com.
Enforcement, Lawful Disclosures, and Onward Transfers
Ashurst Perkins Coie DPF Entities are subject to the investigative and enforcement authority of the Federal Trade Commission (FTC). Ashurst Perkins Coie DPF Entities may be required to disclose Personal Data in response to lawful requests by public authorities. Ashurst Perkins Coie DPF Entities have liability for onward transfers to third parties unless Ashurst Perkins Coie DPF Entities prove they were not a party to the events giving rise to the damages.
Alternate Dispute Resolution Body
In compliance with the DPF, Ashurst Perkins Coie DPF Entities commit to refer unresolved complaints concerning their handling of Personal Data received in reliance on the DPF to the JAMS Data Privacy Framework (DPF) Dispute Resolution, an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit the JAMS Data Privacy Framework (DPF) Dispute Resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you.
Right to Invoke Binding Arbitration
For complaints regarding DPF compliance not resolved by any of the other DPF mechanisms, you have the possibility, under certain conditions, to invoke binding arbitration. Further information can be found on the official DPF website.

Data Subject Rights
Individuals located in mainland China have the right to:
