Introduction

Arne helps clients resolve complex disputes, delivering strategic and commercially focused counsel to resolve disputes through negotiations, mediation or arbitration.

Working with a multinational team of lawyers, Arne Fuchs is a trusted advisor to corporate and sovereign clients for complex, politically sensitive matters across industries and jurisdiction. He has vast experience with disputes revolving around large scale infrastructure and energy projects (conventional, nuclear and renewable), in the mining and natural resources sector, M&A transactions, as well as innovative product and industry transformation issues, including in the automotive, crypto, health, pharma & chemicals, and TMT sectors. He has experience with disputes under most major institutional rules (including ICC, LCIA, HKIAC, SCAI, SCC and DIS Rules), the ICSID Convention and UNCITRAL Rules as well as with pure ad hoc arbitration.

Arne also assists clients defend against complaints and civil claims in the context of alleged ESG and human rights compliance breaches, including along supply chains.

In addition to his role as counsel, Arne is acting as (sole/co-/presiding) arbitrator.

Arne has been recognized by Global Arbitration Review (GAR) 2023 as a "Global Leader" and "National Leader (Germany)" for arbitration. He has been recognized among the 2023 JUVE '40 under 40'. Similarly, leading directories such as GAR 100, Chambers, Legal 500 and the Expert Guide Commercial Arbitration recommend him for his dispute resolution expertise. Arne is a Fellow of the Malaysian Institute of Arbitrators (FMIArb). He is included on the list of arbitrators of the Japan Commercial Arbitration Association (JCAA), the Panel of Arbitrators of the Asian International Arbitration Centre (AIAC), the original pool of arbitrators and mediators at the Court of Arbitration for Art (CAfA) in The Hague, Netherlands as well as the Panel of Mediators of the Energy Community in Vienna, Austria.

Arne serves as delegate of the German National Committee of the ICC on the ICC Commission on Arbitration and ADR and is a Member of the HKIAC Users’ Council as well as of the Arbitration Committee of the International Bar Association (IBA). He regularly speaks on international arbitration topics and teaches training courses and workshops on dispute resolution.

Arne is admitted to the German Bar. He is a native level German and English speaker, speaks fluent French and reads Spanish.

  • Global Mining Company | Representing a global mining company in its dispute with a European State concerning investments in excess of EUR 1 billion. 
  • Sovereign State | Defending a sovereign State against claims in excess of USD 1.5 billion in an investment arbitration under a bilateral investment treaty (UNCITRAL Arbitration Rules, PCA administered, seated in The Hague).
  • Building Materials Company | Representing a global building materials company and its international subsidiaries in an investment arbitration against an African State arising under several bilateral investment treaties and concerning investments in excess of USD 1 billion (ICSID Convention). 
  • Energy Company | Representing a global energy company in an arbitration concerning claims worth approx. USD 1 billion, with complex issues around parallel proceedings and injunctive relief (SCC Arbitration Rules). 
  • Tech and Data Centres | Representing a global telecommunications company in an arbitration concerning claims and counterclaims in excess of USD 100 million revolving around data centre migration and operation issues (DIS Arbitration Rules, German law, seated in Munich).

  • Real Estate Development Company | Representing a global real estate development company in a commercial arbitration arising out of a high-profile real estate transaction, with claims and counterclaims worth approximately USD 35 million (DIS Arbitration Rules, German law).
  • Construction and Engineering Company | Representing an international construction and engineering conglomerate from Spain in an arbitration against an Italian construction company about claims and counterclaims concerning a large infra-structure project in Latin America (ICC Arbitration Rules, New York law).
  • Healthcare | Representing a global healthcare company in relation to product recall issues and related claims in 20+ jurisdictions.
