With more than 30 years of government contracts experience, Kelley helps clients conduct business with federal, state, and local governments.
Kelley P. Doran represents domestic and foreign clients selling products and services to federal, state, and local governments. He counsels, negotiates, and litigates on behalf of government contractors and subcontractors in industries such as information technology, cybersecurity, aerospace and defense, life sciences, and biodefense.
Kelley counsels information technology companies in matters involving both civilian and defense agencies. He has experience in Federal Acquisition Regulation (FAR) Part 12 (Acquisition of Commercial Products and Commercial Services), IP issues related to data rights and subject inventions under FAR Part 27 (Patents, Data, and Copyrights) and U.S. Department of Defense (DoD) FAR Supplement Part 227 (Patents, Data, and Copyrights), as well as evolving government-unique AI requirements. Kelley has negotiated several Cooperative Research and Development Agreements (CRADAs)and Other Transaction Agreements (OTAs)on behalf of clients.
In addition, Kelley works in the areas of biodefense and pandemic influenza preparedness, advising clients on contracts and grants with various federal agencies. These include the Biomedical Advanced Research and Development Authority (BARDA) under the U.S. Department of Health and Human Services (HHS), the U.S. Centers for Disease Control and Prevention (CDC), the National Institutes of Health (NIH), the U.S. Department of Veterans Affairs, and the DoD. Kelley has been involved in large Project BioShield procurements, including programs for anthrax, botulism, smallpox, Ebola, and influenza, as well as Operation Warp Speed and related programs addressing the COVID-19 pandemic.
As outside counsel to contractors before various administrative tribunals, Kelley's practice includes protesting and defending contract awards before the Government Accountability Office (GAO). He also assists clients in addressing compliance issues associated with public procurements, including establishing compliance programs, conducting internal investigations, responding to government investigations, and assessing the need for mandatory disclosures. Kelley has represented domestic and foreign companies in the acquisition and sale of government contracts and businesses and regularly advises companies on government-unique information systems security and cyber requirements, including DoD’s Cybersecurity Maturity Model Certification (CMMC).
Kelley has served as an adjunct professor teaching government contracts law at his alma mater, Washington and Lee University School of Law, as well as the University of Baltimore School of Law.
