Introduction
Emma is an experienced international arbitration practitioner and advocate, with a particular focus on complex energy, infrastructure and natural resources disputes.
Emma has experience of both commercial and investment treaty arbitration, under all of the major arbitral rules and for clients in various sectors. She has a particular focus on the energy and natural resources sectors. Emma has acted in various gas price re-openers and in gas and LNG supply disputes, as well as in proceedings relating to the construction, operation and maintenance of various energy infrastructure projects.
Emma conducts her own advocacy, before both civil and common law tribunals, and has been recognized as a 'Next Generation Partner' in Legal 500 since 2019, an Up and Coming Partner in Chambers and Partners since 2022 and a Rising Star in Legal 500's International Arbitration Powerlist.
Emma is a member of the ICC's UK Arbitration & ADR Committee.
- A Saudi-based energy company | Proceedings relating to the construction and operation of a concentrated solar power plant, including claims relating to defects, plant underperformance, operation and maintenance (English law, ICC Rules, Paris seat).
- A Bahraini energy company | Proceedings arising out of the construction of an offshore floating regasification terminal and storage unit, including complex defect and variation claims (English law, ICC Rules, London seat).
- Spanish and Egyptian energy companies and a consortium of banks | Proceedings under an LNG tolling contract relating to toll-or-pay debt claims and related force majeure defences based on the Egyptian Revolution (English law, ICC Rules, Paris seat).
- An English construction company | Dealing with complex defect claims arising under an EPC Contract for the construction of a subsea electricity transmission export cable (English law, Adjudication and ICC Rules, London seat).
- A waste wood biomass supplier | Proceedings relating to take-or-pay and force majeure claims under an agreement for the supply of waste wood to a biomass facility in the UK. (English law, LCIA Rules, London seat).
- A professional services firm | Successful pursuit of a significant debt claim on a fast-tracked timetable, including subsequent enforcement proceedings in the US (English law, LCIA Rules, London seat).
- An Italian energy company | A gas price reopener under a long-term contract for the supply of Libyan gas to Italy (Italian law, ICC Rules, Paris seat).
- Dutch and Ukrainian renewables companies | Debt claims in respect of investments in the wind and solar industry in Ukraine, including acting in complaint proceedings under the Energy Community Treaty and advising in relation to potential parallel BIT and ICC proceedings.
- The Democratic Republic of Timor-Leste | Proceedings before the International Court of Justice against Australia arising out of the seizure of privileged state documents and related maritime boundary issues, including successfully obtaining provisional measures.
