Introduction

Sara counsels clients on labor and employment law issues, offering preventative counseling, policy development, and defense at the federal, state, and administrative levels.

Sara Whaley (Davey) provides strategic advice to employers on workplace issues, such as employee discipline and termination, disability accommodation requirements, requests for leave, employment and severance agreements, and discrimination and harassment investigations. She assists employers with implementing wage and commission structures, addressing hidden liabilities related to temporary workers and independent contractors, and following legal developments in cannabis law.  

Sara counsels clients on developing employment policies and employee handbooks that fit their culture, including covering multiple jurisdictions.   

As an experienced litigator, Sara has successfully defended all types of labor and employment claims. She also provides labor and employment law support on diligence in M&As for public organizations and private companies.  

With experience in all phases of litigation, Sara has had several successful summary judgment motions relating to retaliatory discharge, the Illinois Whistleblower Act, First Amendment retaliation, sexual harassment, and Title VII and Section 1981 discrimination claims. She also has jury trial experience on Americans with Disabilities Act and sexual harassment claims. In addition, she regularly protects client interests before the U.S. Equal Employment Opportunity Commission and other state workforce agencies.
