Nina Fitzgerald has a wealth of experience in disputes involving complex and unique technologies, including in the pharmaceutical and life sciences, digital economy, financial services and mining and resources sectors. She is experienced in patent, copyright, trade mark, Australian Consumer Law and contract litigation, including before the Federal Court, Full Federal Court and High Court. She advises on all aspects of disputes, including pre-action strategy, freedom to operate, oppositions in the Registry, interlocutory injunctions, mediations, trials, appeals and damages claims. She has also acted in a number of intellectual property arbitration proceedings.

Nina also assists her clients to protect and commercialize their intellectual property and technology. She regularly advises on licensing, assignment, collaboration, services, research and other contractual arrangements concerning IP rights, as well as providing IP advice on major corporate transactions. Nina regularly advises clients on applicable regulatory regimes (for example, the Therapeutic Goods Administration), as well as advertising laws.

Nina has a focus on the interaction between AI and IP and is a thought leader on the legislative changes required to accommodate developments in AI.
