Introduction
Andrew acts for a wide range of high-profile clients across the mining, energy and infrastructure sectors, in relation to complex tenure, native title and cultural heritage matters.
Andrew Gay advises on tenure strategies, land acquisitions and divestments, development projects and planning matters. Andrew also advises on complex matters involving Crown tenure and land access arrangements, including compulsory acquisitions.
Andrew also advises clients on native title and cultural heritage matters, including appearing for corporate respondent party clients in native title claims proceedings, and advising on and negotiating native title and cultural heritage agreements between clients and traditional owner groups.
Andrew has negotiated some of Australia's largest and most-comprehensive native title and Aboriginal heritage agreements.
- A major iron ore producer | Lead partner | 2009 – ongoing | In relation to the negotiation and implementation of comprehensive native title agreements relating to its entire Western Australian operations (covering 9 different native title groups).
- Australian Renewable Energy Hub (AREH) | Advised on all tenure, native title and heritage aspects of the proposed ~20GW AREH Project.
- Ascot Capital Limited and Lewis King Law | Lead partner | 2021-2022 | Advised Ascot Capital Limited and, primary counsel, Lewis King Law on the portfolio sale of 27 industrial and commercial properties across Australia.
- Copenhagen Infrastructure Partners | Lead partner | 2021 - ongoing | Advising on property, native title and heritage matters relating to the proposed Murchison Hydrogen Renewable project, the development of a 5.2GW green ammonia project on Murchison House Station north of Kalbarri.
- Gold Fields Limited | Lead Partner | 2022-2026 | Advised Gold Fields in its negotiations for a new native title agreement with Tjiwarl Aboriginal Corporation, covering the totality of Gold Fields' Agnew Gold Mine operations and infrastructure, and in its negotiations for a new native title agreement with Ngadju Native Title Aboriginal Corporation, covering the totality of Gold Fields' St Ives Gold Mine operations and infrastructure.
