Introduction
Aaron defends companies in government investigations and advises clients regarding compliance with state and federal privacy, data security, and consumer protections laws.
Aaron Haberman helps businesses handle investigations by the FTC and state attorneys general in states including California, New York, and Texas. He has advised businesses in investigations on topics such as data security incidents and safeguards, online advertising practices, collection and use of geolocation information, use of consumer data for AI model training, email marketing, consumer review and endorsement practices, advertising substantiation, and billing practices.
Aaron also has an active counseling practice, where he advises companies on compliance with state and federal laws, including the FTC Act, Telephone Consumer Protection Act and similar state laws, the Controlling the Assault of Non-Solicited Pornography and Marketing Act, the Health Insurance Portability and Accountability Act, the Children's Online Privacy Protection Act, Section 230 of the Communications Decency Act, and state privacy laws. Additionally, he counsels companies on advertising claim substantiation, recurring subscriptions, influencer marketing, sponsored content, and restricted advertising matters. Aaron’s experience developing strategies in government investigations and advocating before regulators helps him deliver efficient, thorough, and risk-calibrated advice.
Aaron is experienced in guiding companies through data security incidents large and small, including leading incident investigations, working with security engineers advising companies on regulator and consumer notice obligations, helping prepare forensic reports, and responding to regulator inquiries.
During his time at the FTC, Aaron led an investigation resulting in a $150 million settlement and industry bans for a company and key actors, including its CEO. He also litigated student debt relief and multi-level marketing cases and contributed to nonpublic investigations on issues such as consumer lending practices, advertising claims, telemarketing, and debt collection.
